Below is a prototypical affidavit for completion by any Local which does not have a special law and does not have a Department treasurer. In such instances, presumably, the 2% money goes directly to the fiscal officer of the municipality who, in turn, forwards it to the Benevolent.
We are asking that affidavits be completed for use in a lawsuit brought against the Plattsburgh Benevolent by the City of Plattsburgh. The City wants to hold the money, doling it out when requested by the Benevolent, but only to the extent it deems the use appropriate. The Judge wants to know what other Departments and municipalities do. We are seeking affidavits, attesting to the fact that the municipalities simply hand the payment to the Benevolent and do not micro-manage how it is spent.
